Introduction
Welcome to the website of DAR Foundation (“we,” “us,” or “our”), a US-based 501(c)(3) nonprofit organization dedicated to rescuing abused, abandoned, and neglected dogs from the streets of Mexico and placing them in loving, permanent homes. We operate in partnership with Fundación DAR, a shelter located in Tequisquiapan, Mexico.
These Terms of Use (“Terms”) govern your access to and use of our website at www.darfoundationrescue.org, including all content, features, and services offered through the site. By accessing or using our website, you agree to be bound by these Terms. If you do not agree with these Terms, please do not use our website.
Use of Our Website
Our website is provided for informational purposes, to facilitate donations, to promote dog adoption and virtual adoption programs, to recruit volunteers, and to connect with rescue organizations and supporters.
You agree to use our website only for lawful purposes and in a manner that does not infringe upon the rights of others or restrict or inhibit anyone else’s use and enjoyment of the website. You agree not to misrepresent your identity or provide false information on any form, application, or communication submitted through our website.
Donations
All donations made to DAR Foundation through our website are processed by third-party payment providers, currently Zeffy and PayPal. By making a donation, you agree to the following:
Tax-Deductible Contributions: DAR Foundation is a registered 501(c)(3) nonprofit organization. All donations are tax-deductible to the extent permitted by US federal and state law. You will receive a donation receipt for your records.
Use of Funds: Donations are used to support the rescue, rehabilitation, medical care, spay/neuter programs, transport, and rehoming of dogs at Fundación DAR in Mexico. While we make every effort to honor donor preferences, DAR Foundation reserves the right to allocate funds where they are most needed to fulfill our mission.
No Refund Policy: Due to the nature of charitable giving and the immediate use of funds for animal care, donations are generally non-refundable. If you believe a donation was made in error, please contact us at contact@darfoundationrescue.org and we will review your request on a case-by-case basis.
Third-Party Payment Processors: When making a donation, you will be directed to or interact with Zeffy or PayPal to complete your transaction. These services are governed by their own terms and conditions. DAR Foundation is not responsible for the practices or policies of these third-party providers.
Virtual Adoption Program
Our virtual adoption program allows supporters to sponsor a specific dog at Fundación DAR by making a recurring or one-time financial contribution toward that dog’s care.
Nature of Virtual Adoption: A virtual adoption is a sponsorship and does not constitute legal ownership of the animal, nor does it grant you any rights to physical custody of the dog. The dog remains in the care of Fundación DAR unless and until it is placed in a permanent adoptive home.
Updates: We make every effort to provide updates about your sponsored dog. However, circumstances at the shelter (including the dog being adopted, transferred, or passing away due to illness or injury) may affect the availability of updates. In such cases, we will notify you and offer the option to sponsor a different dog or redirect your contribution to general shelter support.
Sponsorship Contributions: Virtual adoption contributions are treated as donations to DAR Foundation and are tax-deductible. The same donation terms described above apply.
Dog Adoption
DAR Foundation facilitates the adoption of dogs from Fundación DAR to homes in the United States and Canada. By submitting an adoption application, you agree to the following:
Application Process: Submitting an adoption application does not guarantee approval or placement of a dog. DAR Foundation reserves the right to approve or deny any application at our sole discretion based on the best interest and welfare of the animal.
Accuracy of Information: You agree to provide truthful, accurate, and complete information on your adoption application. Providing false or misleading information may result in denial of your application or, if discovered after placement, may be grounds for reclaiming the animal.
Adoption Fees: Adoption fees may apply to cover veterinary care, vaccinations, spay/neuter surgery, transport, and other costs associated with preparing a dog for adoption. Specific fees will be communicated during the adoption process.
Adoption Agreement: Approved adopters will be required to sign a separate adoption agreement outlining the terms and responsibilities of dog ownership, including providing proper care, veterinary attention, and a safe living environment. DAR Foundation reserves the right to conduct follow-up checks after placement.
Transport and Logistics: The transport of dogs from Mexico to the United States or Canada involves coordination between DAR Foundation, Fundación DAR, and potentially partner organizations or transport services. While we take every reasonable precaution to ensure the safety and well-being of the animals during transport, DAR Foundation cannot guarantee against unforeseen delays, health complications, or other circumstances beyond our control.
No Guarantee of Behavior or Health: While we provide all known health and behavioral information about each dog, DAR Foundation cannot guarantee the future health, temperament, or behavior of any adopted animal. Dogs from rescue backgrounds may have unknown histories, and adopters accept this risk.
Volunteer Applications
We welcome volunteers who wish to support our mission. By submitting a volunteer application, you agree to the following:
Application Review: Submitting a volunteer application does not guarantee acceptance into our volunteer program. We review all applications and select volunteers based on our current needs, the applicant’s skills and availability, and the suitability of the match.
Volunteer Responsibilities: Accepted volunteers are expected to act in a manner consistent with DAR Foundation’s mission and values, treat all animals and people with respect and compassion, follow instructions and guidelines provided by DAR Foundation, and maintain the confidentiality of any sensitive information they may encounter during their volunteer activities.
Volunteer Status: Volunteers are not employees, contractors, or agents of DAR Foundation. Volunteer work is performed on a purely voluntary basis without compensation. Volunteering does not create an employment relationship.
Intellectual Property
All content on our website — including but not limited to text, photographs, images, graphics, videos, logos, page layouts, and design elements — is the property of DAR Foundation or is used with permission from the respective rights holders (including Fundación DAR).
Permitted Use: You may view, download, and print content from our website for personal, non-commercial use only, provided you do not modify the content and you retain all copyright and proprietary notices.
Prohibited Use: You may not reproduce, distribute, modify, create derivative works from, publicly display, or commercially exploit any content from our website without prior written permission from DAR Foundation. This includes but is not limited to copying photographs or profiles of dogs for use on other websites, social media accounts, or fundraising platforms without our authorization.
Sharing: We encourage you to share links to our website and social media pages to help promote our mission. When sharing our content on social media, please credit DAR Foundation appropriately.

Indemnification

Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Arizona, United States, without regard to its conflict of law provisions. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in Maricopa County, Arizona.
